Terms of Use & End-User License Agreement (EULA)

This Agreement (“Terms”) is a legal agreement between you and Daytiko sp. z o. o. (“Owner”, “we”, “us”) regarding the Daytiko mobile application and related services (“Software” or “Service”). By installing or using the Software, you agree to these Terms. If you do not agree, do not install or use Daytiko.


1. License

Daytiko is licensed, not sold. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to use one copy of the Software on your mobile device for personal, non-commercial purposes. All other rights are reserved by the Owner.

2. Restrictions on Use

You may not (and may not permit anyone to): copy, distribute, publicly perform, or publicly display the Software except as expressly permitted; reverse engineer, decompile, disassemble, or otherwise attempt to derive source code (except to the extent such restrictions are prohibited by law); modify, translate, or create derivative works; rent, lease, sell, assign, sublicense, or transfer rights; bypass or circumvent security or technical limitations; remove or alter copyright, trademark, or proprietary notices. Any violation automatically terminates your license.

3. Intellectual Property

The Software and all materials therein (excluding User Content) are owned by the Owner or its licensors and are protected by intellectual property laws. Using the Software does not transfer any ownership rights to you.

4. Accounts & Age

Some features require a Google account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. The Service is not intended for individuals under the minimum age of digital consent applicable in your country (typically 13–16). If you are under that age, you must have verifiable parental/guardian consent.

5. User Content (Google Drive Storage)

You retain all rights to the content you create or store using the Service (“User Content”). We do not host User Content and do not keep persistent copies. User Content is stored in your Google Drive account and is subject to Google’s terms and privacy policy.

The Software accesses Google Drive only via your explicit authorization (OAuth) and only within granted scopes. Access is revocable at any time in your Google Account settings. We do not routinely access, review, or moderate User Content and do not use it for advertising, analytics, or model training. Temporary processing (e.g., caching, encryption in transit, local device storage) may occur solely to operate the Service and is not retained beyond what is necessary.

You are solely responsible for your User Content and for managing your Google Drive storage, permissions, and backups. We cannot restore deleted or inaccessible content and cannot decrypt or recover files from your Google account. Upon credible notice or a lawful request addressed to us, we may disable the Software’s access to your Google Drive, but we cannot remove or edit files stored in your Google account.

Security note: Data are encrypted in transit and at rest by Google. This is not end-to-end encryption managed by us (we do not manage your content encryption keys).

6. Acceptable Use

You may not use the Service to upload, store, share, or otherwise process content that is illegal; sexually exploitative or involving minors (CSAM); malware or code intended to disrupt systems; infringes intellectual property or privacy rights; promotes violence or hatred; constitutes spam or abusive behavior; attempts to bypass security or access others’ data; or otherwise violates these Terms or applicable law. We may disable the Software’s access (and/or your account’s use of the Software) where we reasonably believe a violation occurred or upon lawful order.

7. Updates and Changes to the Service

We may update Daytiko, add features, or remove features. Some updates may be required to continue using the app. We may suspend or discontinue parts of the Service. Security, compatibility, and critical fixes may be installed without additional notice.

8. Subscriptions and One-Time Purchases (Google Play)

  • Free version: Basic functionality without time limit.
  • Trial period: Full functionality for a limited time (as shown in Google Play).
  • Premium subscription: Monthly or yearly; auto-renews unless canceled in Google Play.
  • One-time purchases: Grant access to specified features; final and non-refundable (unless required by law).

Payments are processed via Google Play and are subject to its terms and policies.

8.1 Free Trial & Auto-Renew

Unless you cancel, your subscription converts to a paid plan at the end of the trial and auto-renews. To avoid charges or renewal, cancel in Google Play at least 24 hours before the end of the current period. Pricing, duration, and trial availability are displayed in Google Play before purchase.

8.2 Price Changes & Taxes

Prices may change. Google Play handles notifications (where applicable). Taxes may apply; the final amount is shown in Google Play at checkout.

8.3 Manage & Cancel

Manage or cancel in Google Play → Payments & Subscriptions. Deleting the app does not cancel a subscription.

9. Refunds

Refunds are governed by Google Play policies and applicable law. In some jurisdictions, the right of withdrawal for digital content may not apply once delivery begins with your express consent and acknowledgment of losing that right.

10. Third-Party Services

Google Drive: The Service relies on Google Drive. Your use of Google Drive is governed by Google’s terms and privacy policy. We do not control Google’s availability, rate-limits, API changes, or outages, and we are not responsible for resulting data unavailability or loss. You can manage/revoke Daytiko’s access in Google Account → Security → Third-party access.

Google Play Billing: Purchases are handled by Google Play. We do not control Google Play’s billing operations or timelines. Issues with payment processing should be addressed via Google Play support.

11. Privacy & GDPR

Personal data processing is described in our Privacy Policy. For app accounts and billing-related data, the Owner acts as a data controller. For Google integrations (e.g., Google Drive), your data are also subject to Google’s policies. You may have rights under applicable law (e.g., access, rectification, deletion, objection, portability). Contact: support@daytiko.com.

12. Data Deletion & Backups

When you delete content in the app, we remove or unlink it from Daytiko’s access, but files in your Google Drive remain governed by Google’s behavior and your settings. We do not keep server copies. If you delete your account, we cease processing your data subject to technical delays and residual copies in operational logs that are deleted in the ordinary course.

13. Beta / Experimental Features

Some features may be offered as beta or experimental. They are provided “AS IS” and may be changed, suspended, or removed at any time.

14. Feedback

If you submit ideas, suggestions, or feedback, you grant us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free license to use them without obligation to you.

15. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant uninterrupted or error-free operation or that all defects will be corrected.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES (INCLUDING LOSS OF DATA, PROFITS, REVENUE, GOODWILL, OR BUSINESS INTERRUPTION). OUR TOTAL LIABILITY FOR ANY CLAIMS RELATING TO THE SOFTWARE SHALL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID FOR THE MOST RECENT SUBSCRIPTION PERIOD OR PURCHASE.

Carve-outs: The above limitations do not apply where prohibited by law, including liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or willful misconduct.

17. Indemnification

You agree to defend, indemnify, and hold harmless the Owner from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way related to: (a) your violation of these Terms; (b) your User Content; or (c) your unlawful use of the Service.

18. Responsible Disclosure

We welcome responsible reports of security vulnerabilities at security@daytiko.com. Do not exploit vulnerabilities, access others’ data, or perform denial-of-service attacks.

19. Governing Law & Venue; Consumer Rights

These Terms are governed by the laws of Poland. Except where mandatory consumer laws provide otherwise, the courts of Warsaw, Poland, have exclusive jurisdiction. Nothing in these Terms limits your non-waivable consumer rights under applicable law.

20. Force Majeure

We are not liable for delays or failures caused by events beyond our reasonable control, including acts of God, natural disasters, war, terrorism, civil unrest, labor disputes, internet or telecom failures, or changes in laws/regulations.

21. Assignment

We may assign or transfer these Terms (in whole or part) in connection with a merger, acquisition, corporate reorganization, or sale of assets. You may not assign these Terms without our prior written consent.

22. Severability; No Waiver; Entire Agreement; Notices

If any provision is held unenforceable, the remaining provisions will remain in full force. Our failure to enforce any provision is not a waiver. These Terms constitute the entire agreement between you and us regarding the Software and supersede any prior agreements. We may provide notices within the app, on our website, or via email.

23. Changes to Terms

We may update these Terms from time to time. The updated version will be available in the app or on our website and is effective upon posting unless stated otherwise. Continued use constitutes acceptance of the revised Terms.
